Illinois Supreme Court hearing two class action suits alleging hospitals previously violated Biometric Information Privacy Act

The Biometric Information Privacy Act was the subject of arguments heard before the Illinois Supreme Court this week.

Two class action suits allege that hospitals violated the Act by requiring nurses to scan fingerprints to open medicine cabinets; the nurses allege that the hospitals did not obtain written releases and other violations.

In 2021, Facebook settled a claim under the Act for $650 million after Illinois users alleged Facebook misused biometric data.

Fast food chain White Castle is currently defending a case under that Act that could result in billions of dollars in damages.
