The City of Springfield is continuing its aggressive pushback against a lawsuit that is trying to have the city’s coal contract overturned.

Springfield residents Michael and Jennifer Frakes are suing as taxpayers, saying the deal with Arch Coal was not a good deal and contending that aldermen were not told of a report from Ely Consulting that suggested a better price could be obtained.

The city has now released a recording of an executive session where aldermen were told about the report and offered the chance to review it.

But city attorneys said the report could not be released publicly at that time because of attorney-client privilege while negotiations were ongoing.
